These Terms & Conditions ("Terms") govern your access to and use of MapBhoomi (the "Service"), a cloud-based software platform operated by Blindersoe Private Limited ("Company", "we", "us", or "our"), CIN U72200AP2023PTC123908.
By creating an account, subscribing, or using the Service, you ("Customer", "you", or "your") agree to be bound by these Terms, our Privacy Policy, and any order form or plan description applicable to your subscription. If you do not agree, do not use the Service.
1. Definitions
- Service: the MapBhoomi web application, APIs, documentation, and related software provided by the Company.
- Account / Workspace: your registered company environment on the Service.
- Subscription: a paid plan granting access to the Service for a defined billing period.
- User: any individual authorised by you to access the Account.
- Customer Data: data, content, and materials you or your Users submit to or store in the Service.
- Order: a checkout or invoice for a Subscription, add-on seats, or other billable items.
2. Eligibility and account registration
- You must be at least 18 years old and have authority to bind your organisation.
- Registration information must be accurate, current, and complete. You are responsible for keeping it updated.
- You are responsible for all activity under your Account and for safeguarding credentials.
- Email verification and multi-factor authentication may be required. You agree to cooperate with security measures we implement.
- One person or legal entity may not maintain more than one free-trial Account for the same business purpose where prohibited by us.
3. Licence and permitted use
Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes during your Subscription term.
You may not:
- Copy, modify, reverse engineer, decompile, or create derivative works of the Service except as permitted by law.
- Resell, sublicense, or make the Service available to third parties except as expressly allowed under a separate reseller or partner agreement with us.
- Remove proprietary notices or circumvent access controls, usage limits, or security features.
- Use the Service to build a competing product or to scrape data in violation of these Terms.
- Upload malware, unlawful content, or material that infringes third-party rights.
- Interfere with or disrupt the integrity or performance of the Service.
4. Customer Data and privacy
- You retain ownership of Customer Data. You grant us a licence to host, process, and display Customer Data solely to provide and improve the Service.
- You are responsible for the accuracy, legality, and appropriateness of Customer Data and for obtaining necessary consents from data subjects.
- Our handling of personal information is described in the Privacy Policy.
- You must not submit sensitive categories of data (e.g. health, biometric, or financial account credentials of end customers) unless the Service explicitly supports such use and you have implemented appropriate safeguards.
5. Subscriptions, billing, and payment
- Plans and pricing: fees are as displayed at checkout or on your Order. Prices may be shown in INR or other supported currencies. Applicable taxes (including GST) are additional unless stated otherwise.
- Billing cycle: Subscriptions renew automatically for the selected term unless cancelled in accordance with these Terms.
- Payment: payments are processed through authorised payment gateways (e.g. Razorpay). You authorise us and our payment partners to charge your selected payment method for fees, taxes, and renewals.
- Invoices: tax invoices are issued by Blindersoe Private Limited (GSTIN: 37AALCB3789P1ZO).
- Failed payments: if payment fails, we may suspend access after any applicable grace period until outstanding amounts are paid.
- Price changes: we may change catalog prices for new purchases. Renewal pricing may follow your locked subscription rates or current catalog prices as disclosed at renewal, depending on your plan terms.
- Extra seats and add-ons: additional users or features are billed as described at purchase and follow the same payment and non-refund rules unless expressly stated otherwise in writing.
6. Refund policy
Except where required by mandatory applicable law, all Subscription fees, setup fees, add-on purchases, and other charges are non-refundable. This includes:
- Partially used subscription periods.
- Unused seats, storage, or features.
- Downgrades or cancellations mid-term.
- Automatic renewals, if you failed to cancel before the renewal date.
- Charges resulting from your failure to cancel or from disputed transactions where the Service was delivered.
No refunds after purchase. All sales are final.
If you believe a charge was made in error (duplicate charge, clear technical failure preventing any access), contact [email protected] within seven (7) days of the charge with supporting details. We will investigate in good faith; any corrective action is at our sole discretion and does not create an obligation to provide refunds in other circumstances.
Chargebacks initiated without contacting us first may result in immediate Account suspension pending resolution.
7. Shipping and delivery policy
MapBhoomi is a digital software-as-a-service (SaaS) product. We do not ship physical goods.
- Delivery: access to the Service is provisioned electronically upon successful account registration, email verification (where required), and payment confirmation.
- Activation time: most Subscriptions are activated immediately or within a reasonable period after payment verification. Manual provisioning, if applicable, will be communicated on the Order.
- Availability: the Service is accessed via the internet. You are responsible for your own devices, browsers, and connectivity.
- Updates: we deliver updates, patches, and new features electronically as part of the Service without additional shipping or handling charges unless specified for optional professional services.
8. Cancellation and termination
8.1 Cancellation by you
- You may cancel auto-renewal through account billing settings or by written request to [email protected].
- Cancellation stops future renewals; it does not entitle you to a refund for the current paid period.
- Access continues until the end of the paid Subscription term unless we suspend earlier for breach.
8.2 Suspension or termination by us
We may suspend or terminate access immediately if you:
- Breach these Terms or applicable law.
- Fail to pay amounts when due after notice or grace period.
- Pose a security risk or engage in abusive or fraudulent activity.
8.3 Effect of termination
- Upon termination, your licence ends and you must cease use of the Service.
- We may delete or retain Customer Data per our retention policy and legal obligations. Export your data before termination where the Service provides export tools.
- Sections that by nature should survive (payment obligations, disclaimers, limitation of liability, indemnity, governing law) will survive termination.
9. Acceptable use
You agree not to use the Service to:
- Violate any law, regulation, or third-party rights.
- Send spam, phishing, or unsolicited communications.
- Harass, defame, or distribute hate or violent content.
- Attempt unauthorised access to systems, accounts, or data.
- Overload infrastructure or bypass rate limits.
- Misrepresent identity or affiliation.
We may investigate violations and cooperate with law enforcement where required.
10. Intellectual property
- The Service, software, branding, documentation, and all related intellectual property are owned by Blindersoe Private Limited or its licensors.
- Except for the limited licence in Section 3, no rights are granted to you.
- Feedback you provide may be used by us without obligation or compensation.
11. Third-party services
The Service may integrate with third-party payment processors, maps, messaging, or other services. Those services are governed by their own terms. We are not responsible for third-party outages, policies, or actions.
12. Service availability and disclaimers
- We strive for high availability but do not guarantee uninterrupted or error-free operation.
- Scheduled maintenance and emergency updates may temporarily affect access.
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- We do not warrant that the Service will meet your specific business requirements or that results from use will be accurate or reliable.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- Blindersoe Private Limited SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY.
- OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.
14. Indemnification
You will indemnify, defend, and hold harmless Blindersoe Private Limited, its directors, officers, employees, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your Customer Data or use of the Service; (b) your breach of these Terms; or (c) your violation of law or third-party rights.
15. Reseller and channel partners
Authorised resellers or channel partners may sell or provision the Service only under a separate written agreement with Blindersoe Private Limited. Unless you have entered such an agreement with us, you may not resell, white-label, or commercially redistribute the Service. Reseller terms, commissions, and support responsibilities are defined in the applicable partner agreement and do not modify these Terms for direct customers unless expressly incorporated by reference.
16. Modifications to the Service and Terms
- We may modify features, plans, or these Terms from time to time.
- Material changes to Terms will be posted on this page with an updated effective date. Continued use after the effective date constitutes acceptance.
- If you do not agree to material changes, you must stop using the Service and cancel before the next renewal.
17. Governing law and dispute resolution
- These Terms are governed by the laws of India.
- Subject to mandatory consumer protections, courts in Kurnool, Andhra Pradesh shall have exclusive jurisdiction over disputes arising from these Terms or the Service.
- Before initiating formal proceedings, you agree to contact us at [email protected] to attempt good-faith resolution within thirty (30) days.
18. General provisions
- Entire agreement: these Terms, the Privacy Policy, and applicable Orders constitute the entire agreement regarding the Service.
- Severability: if any provision is unenforceable, the remainder remains in effect.
- No waiver: failure to enforce a provision is not a waiver of future enforcement.
- Assignment: you may not assign these Terms without our consent. We may assign to an affiliate or in connection with a business transfer.
- Force majeure: we are not liable for delays or failures due to events beyond our reasonable control.
